Abstract

The territorial dispute over Gibraltar has been one of the longest-running international conflicts between Spain and the United Kingdom since the 18th century. This conflict started with the Treaty of Utrecht in 1713, which handed Gibraltar over to Britain after Spain's defeat in the War of Spanish Succession. However, Spain has continuously claimed Gibraltar as an integral part of its sovereignty, arguing from both historical and strategic perspectives. On the other hand, the people of Gibraltar have consistently expressed their desire to remain under British sovereignty, as shown through referendums in 1967 and 2002. This dispute has become even more complicated with the involvement of international legal principles like the right to self-determination, territorial integrity, and decolonization. This article aims to analyze Spain’s claim over Gibraltar through the lens of international law, focusing on the historical background, legal foundations, and conflict resolution steps that have been taken so far. This study uses a qualitative method with a literature review approach, relying on international legal documents, bilateral agreements, and academic references. Findings indicate that Spain’s claim is grounded in the principle of territorial integrity, while the United Kingdom bases its stance on the right to self�determination of the people of Gibraltar, who have democratically chosen to remain under British rule. Within the framework of international law, resolving the Gibraltar dispute faces significant challenges. The principles of territorial integrity and self-determination often clash in this case. Additionally, efforts to mediate and negotiate the dispute, whether through bilateral or international forums, have yet to yield a definitive solution.
