Abstract

This research aims to analyze the basis of the judge's considerations in Decision No. 454/Pid.B/2024/PN.Sby and to assess the conformity of this decision with human rights principles. This verdict involves a murder case that has attracted public attention due to alleged negligence in the application of justice principles by the court. Although substantial medical evidence points to the involvement of the defendant, Gregorius Ronald Tannur, in the murder, the court ultimately decided to acquit the defendant of all charges. This outcome raises significant questions regarding the principles of justice and legal certainty within the decision, particularly concerning the right to life and the right to justice that should be afforded to the victim. This study employs normative legal research methods with a statute and case approach, focusing on analyzing primary and secondary legal materials. Primary materials include relevant legislation and court decisions, while secondary materials comprise legal journals, human rights literature, and supporting documents related to human rights application within Indonesia’s judicial system. The study further explores overlooked legal aspects within the judge's considerations and the implications for the victim's rights. Analysis reveals several shortcomings in the judicial decision, including insufficient attention to critical medical evidence that should have been a key factor in determining the cause of the victim’s death. Instead, the court emphasized indirect evidence deemed less relevant to the central issue of the murder case, sparking controversy surrounding the principle of justice. This research aims to contribute to the evaluation of judicial processes, particularly regarding the application of human rights principles in criminal cases requiring transparent and fair handling.
