Abstract

Penelitian ini menganalisis praktik aborsi oleh tenaga medis di Indonesia, khususnya berdasarkan Peraturan Pemerintah No. 28 Tahun 2024. Aborsi yang dilakukan tanpa persyaratan medis yang ketat dan tidak sesuai ketentuan hukum dapat dianggap sebagai tindakan ilegal yang berdampak pada tanggung jawab pidana dan etis tenaga medis. Peraturan Pemerintah tersebut mengatur praktik aborsi yang hanya dapat dilakukan dalam kondisi kedaruratan medis atau sebagai akibat dari tindak pidana kekerasan seksual. Penelitian ini berfokus pada tinjauan yuridis dan etis dalam praktik aborsi yang dilakukan oleh tenaga medis, serta menganalisis batasan hukum yang diberikan untuk menghindari terjadinya malpraktik. Metode yang digunakan dalam penelitian ini adalah pendekatan normatif dengan mempelajari aturan hukum yang relevan. Dengan menelaah Peraturan Pemerintah No. 28 Tahun 2024 sebagai batasan aborsi yang akan aman dilakukan dengan kriteria indikasi kedaruratan medis dan/atau korban pemerkosaan yang mengakibatkan kehamilan, diharapkan masyarakat dapat mengikuti aturan tersebut agar angka aborsi di Indonesia tidak semakin tinggi. Selain itu, Undang-Undang No. 17 Tahun 2023 tentang Kesehatan dan Undang-Undang No. 1 Tahun 2023 tentang KUHP juga termuat unsur dan sanksi yang akan terjadi apabila melakukan aborsi tidak sesuai peraturan perundang-undangan. Hasil penelitian menunjukkan adanya celah dalam peraturan terkait kompetensi, kewenangan, dan akuntabilitas tenaga medis yang berpotensi menimbulkan berbagai tafsir di kalangan masyarakat dan pelaku medis. Penelitian ini memberikan rekomendasi agar peraturan yang mengatur praktik aborsi oleh tenaga medis diperketat dan disosialisasikan dengan lebih efektif untuk memastikan kepatuhan dan pemahaman hukum yang baik di kalangan tenaga medis dan masyarakat
