Abstract

Artificial insemination has become a crucial option for couples facing infertility, especially in cases involving donor sperm and surrogate mothers. This study examines the national and Islamic legal aspects related to the legal status of children born through assisted reproduction. Using a normative juridical method, the study finds that the legal status of these children is still tied to internal family dynamics, and existing regulations only cover legally married couples. From the perspective of Islamic law, the study emphasizes the legitimacy of children through interpretations of the Qur’an and Hadith. This research supports the need for specific legislation on in vitro fertilization and surrogacy to provide legal clarity, including inheritance rights, in accordance with Islamic principles. Holistic and responsive legal policies are necessary to address the complex issues of reproductive technology. This study aims to contribute to the formulation of comprehensive and responsive legal policies that meet the needs of society.
