Abstract

A notary is a public official working in the legal field and also plays a role in creating legal certainty for society in the context of law enforcement. A notary is a state organ authorized by the state through the provisions of Law No. 2 of 2014 concerning Amendments to Law No. 30 of 2004 concerning the Position of Notary (hereinafter abbreviated as UUJN). The application of law between UUJN and the application of criminal law regulated in the Penal Code (KUHP) overlaps, causing legal uncertainty for notaries in case of mistakes in carrying out their duties and authorities. In UUJN, it is stipulated that when a notary performs a violation deviating from the law while carrying out their duties, the notary may be subject to sanctions, namely civil, administrative, or ethical code of the notary profession. This research aims to understand and explain the legal consequences of the forgery of authentic deeds on the legal validity of the deed and to explain the criminal liability of notaries who forge authentic deeds. The method used in this research is normative with a statutory and conceptual approach. The results of this research indicate that the legal consequences of the forgery of authentic deeds on the legal validity of the deed are that if one of the requirements for making the deed is not met properly, the deed will lose its originality and be considered legally defective, resulting in the deed having no valid probative value and being considered invalid. Moreover, the criminal liability of notaries who forge authentic deeds can be subject to Article 264 paragraph 1 of the Penal Code (KUHP).
