Abstract

This research is motivated by the important role of transportation, especially sea transportation, so all activities related to sea transportation need to be regulated by the State because considering the high intensity of shipping in Indonesia, it often allows shipping crimes or crimes at sea to occur. This research presents two problem formulations, namely: 1. What is the process for investigating shipping crimes in Indonesia? 2. What is the criminal liability for entrepreneurs who employ someone on a ship without the documents required by legal authorities? This type of research is normative legal research that uses a statutory approach and a case approach. The conclusion obtained is that the investigation process for shipping crimes is carried out after the investigation process is completed. In article 4 of the regulation of the Head of the National Police of the Republic of Indonesia Number 14 of 2012 concerning Management of Criminal Investigations, including police reports/complaints, assignment orders, investigation results reports (LHP), investigation warrant, and SPDP (order to start an investigation). Criminal liability for entrepreneurs who employ someone on a ship without the documents required by legal authorities is regulated in article 323 paragraph (1) of law number 17 of 2008 concerning shipping outlining criminal sanctions sailing without a sailing approval letter, namely a captain who sails without having a sailing approval letter issued by the Harbormaster as intended in article 219 paragraph (1) shall be punished with a maximum imprisonment of 5 (five) years and a maximum fine of RP. 600,000,000.00 (six hundred million rupiah). It is hoped that this research will enable law enforcers to act fairly, firmly and objectively in upholding justice by prioritizing applicable legal aspects.
