Abstract

Indonesia as a country of law has an obligation to protect disabilities, one of the constitutional rights as regulated in Article 28 I paragraph (2) of the 1945 Constitution of the Republic of Indonesia. The problem in this research is how to legally protect people with disabilities who experience rejection of work registration. ? and how is the right to employment guaranteed for people with disabilities? This research uses a type of normative legal research with a legislative approach. The results of this research show that legal protection for people with disabilities is regulated in Article 67 Paragraph (1) of Law Number 13 of 2003 concerning Manpower which explains that "Employers who employ workers with disabilities are obliged to provide protection according to the type and degree of disability". Technical protection or work safety is used as a basis for reflecting and protecting work safety by creating a work environment that can be used and accessed safely by workers with disabilities while working. The Manpower Department has appealed to companies to implement a 1% quota for each private company and a 2% quota for state-owned companies so that they can employ at least 1% - 2% of the number of workers in the company with disabilities. Guarantee of the right of the disabled to obtain work is regulated in Law no. 8 of 2006 concerning Persons with Disabilities states that persons with disabilities have the right to justice and legal protection to be treated equally before the law in providing accessibility and protection from all pressure, violence, abuse, discrimination, and/or confiscation or taking over of property rights.
