Abstract
This study discusses Building Rights (HGB) placed above Management Rights (HPL) on reclaimed land, viewed from the perspective of the Basic Agrarian Law (Undang-Undang Pokok Agraria or UUPA). The fundamental issue lies in the legal examination of the hierarchy and interaction between Building Rights (HGB) and Management Rights (HPL) in the context of reclaimed land utilization in Indonesia. The purpose of this research is to analyze the conflicts or coherence between these rights and their legal implications. The method used is normative juridical analysis, referencing legislative approaches and conceptual approaches. The main findings indicate that the implementation of Building Rights above Management Rights raises various issues concerning ownership, management, and land use on reclaimed land. UUPA asserts that Building Rights (HGB) grant its holder the right to build and own structures on the land, while Management Rights provide control over land use in general. The implication of this research underscores the importance of deeper legal clarification to balance the rights and obligations among parties involved in Building Rights (HGB) and Management Rights (HPL) agreements. The contribution of this research is expected to provide clearer insights for legal practitioners, government officials, and stakeholders involved in land law regulation in Indonesia.
