Abstract

Rapid developments have opened people's views on various global and national problems. Technology, as the main tool, has produced an innovative mindset among society, allowing for a variety of perspectives and actions, as long as they comply with the rules and norms that apply in the country. Forests are classified based on their functions and roles which are important for managing each forest environment. Social forestry is a sustainable forest management system run by local communities or customary law communities, playing a role in improving welfare and social balance. Types of social forestry include village forests, community forests, community plantation forests, forest partnerships, and customary forests. Conflicts between the interests of mining companies and the rights of indigenous communities often arise due to inadequate legal protection and unequal power. This thesis uses a type of normative legal research, which refers to legal norms in statutory regulations, to examine this problem in depth and propose appropriate solutions for legal protection and guarantees for the continuity of Customary Forests and Ulayat Rights. The results of the research are that social forestry management through LHK Ministerial Regulation No. 9 of 2021 concerning social forestry management is problematic for the existence of customary forests of customary law communities which have been owned for generations because customary law communities will lose their customary forest rights which have been obtained for generations. , secondly, in establishing customary forest mechanisms, customary law communities must first use regional regulations as mandated by Law 41 of 1999 concerning Forestry, thirdly, it violates the substance of customary forests which has been decided by the Constitutional Court through Constitutional Court Decision No.35/PUU-IX/2012 About Customary Forests. And the hierarchy of statutory regulations no. 12 of 2011 specifically on regional regulations. So in article 3 of this regulation, special social forestry management must be removed from customary forest management. Because it violates the substance of community rights that have been owned for generations.
