Abstract

The curator is a party in the bankruptcy process who has the responsibility to manage and settle the assets of the debtor who is declared bankrupt. This large responsibility does not preclude the possibility that the curator will act negligently in his duties. The negligence in question is the actions of the curator intentionally or unintentionally resulting in losses to the bankruptcy estate. Even though the Bankruptcy Law stipulates that if the curator acts negligently and results in loss of the bankrupt's assets, the curator can be held responsible. However, this still cannot provide legal certainty regarding the sanctions that will be imposed on the curator. Therefore, there is a need for study and analysis regarding civil liability and the imposition of sanctions for the curator's negligent actions in managing the bankruptcy assets of PT Istaka Karya (Persero). As regulated and explained in Article 1365 of the Civil Code, it can be used as a legal basis for providing legal certainty regarding the curator's negligent actions. The curator's negligent actions can be held responsible for compensation by the injured party. The provisions of Article 1365 of the Civil Code are the basis for applying sanctions, as the curator's negligent actions can be qualified as unlawful acts and there is a cause and effect relationship for his actions. Thus, it is still not further regulated by the Bankruptcy Law that there is a need for a review of the implementation of the Bankruptcy Law, which in this case regulates the responsibility of curators for their negligence in the bankruptcy process.
