Abstract
Doctors are responsible for medical dispute cases even though they have immunity rights regulated by Act 17 of 2023. This study explores the concept and implementation of physician immunity rights in the context of modern medical law. The focus is on analyzing how physicians can remain responsible for medical errors or clinical decisions that could potentially harm patients, although their immunity rights may provide certain legal protection. This study uses a normative juridical research method that examines and examines existing and applicable legal rules. This study uses a comparative legal approach and a case study to evaluate the protection provided by Act 17 of 2023 against physicians in various jurisdictions. The study also examined how interpretation and implementation of this law affect the resolution of medical disputes, including arbitration, mediation, or trial processes. There are mechanisms that allow the prosecution or responsibility of physicians in cases that meet certain criteria, such as obvious medical errors or serious ethical violations. It highlights the importance of a balance between providing appropriate legal protection for physicians to exercise their medical practice and justice for patients who can feel disadvantaged and legal protection against patients due to medical disputes.
