Abstract

By keeping up with developments in technology and information, there are many payment methods that are commonly used, one of which is using Giro, to facilitate transactions for people who have business or other interests, but this also has its drawbacks, one of which is empty giro fraud, meaning several individuals who is not responsible for using payments using a Giro, but the Giro used for the transaction is empty, or there is no balance in the account listed on the Giro. This research is to examine the characteristics of criminal acts that can use a Restorative Justice approach, especially in resolving empty Bilyet Giro fraud cases. Restorative Justice is an alternative conflict resolution that emphasizes recovery, reconciliation and active participation of all parties concerned. Using a normative research methodology approach, analysis was carried out on the legal principles underlying Restorative Justice, as well as their relevance in the context of Indonesian criminal law. This research method involves collecting data through in-depth literature study of legal literature, which is related to the implementation of Restorative Justice in resolving similar cases. Based on this research, it was found that the characteristics of criminal acts such as embezzlement of empty checking accounts qualify for the Restorative Justice approach because they do not involve serious physical violence and often involve a personal relationship between the perpetrator and the victim. With technological developments, there are many practical payment methods, including using the Giro payment tool. This is of course a new mode used by irresponsible individuals, by using empty Giro as a transaction tool against victims. The results of this research provide a theoretical contribution by expanding understanding of the application of Restorative Justice in the context of criminal law, as well as providing practical recommendations for law enforcement officials and the community in handling similar cases with a more humane and effective approach.
