Abstract
This research discusses the protection of brand recording rights for brand owners outside Indonesia. Indonesia is included in the United States' priority wacth list because Indonesia has not been able to provide complete protection, including brand recording, therefore there needs to be a comprehensive analysis in order to create rights protection and healthy trade competition. This thesis is a normative research that evaluates the legal framework for trademark protection in Indonesia, especially in terms of registration and recording of foreign trademarks. Through concept analysis and comparison with trademark law in the United States and China, this research has its own novelty from previous research. The aim of this research is to identify the main obstacles faced by foreign brand owners in protecting their intellectual property rights in Indonesia, as well as to propose solutions that can optimize the trademark protection system in this country. The findings of this research found that regulations in Indonesia, namely Article 5 paragraph 3 of the 2017 Government Regulations, are not in accordance with the concept of brand protection and are not in accordance with international conventions and agreements resulting in discrimination in brand recording regulations for brand owners outside Indonesia, so they must be changed and harmonized according to the convention. and applicable international agreements. This research also found regulations that are in accordance with international conventions and agreements by looking at regulations in the United States and China because these two countries have provided flexible and easy regulations for foreign trademarks.
