Abstract

Acts of sexual violence committed by children show an increase. Sexual violence has been a crime that has existed for a long time. Children are often involved in sexual violence, both as perpetrators and victims. This can be caused by children being vulnerable to manipulation because they do not yet have the full ability to make decisions or because they are a vulnerable group who do not have the power to defend themselves. This case really requires serious handling, so this research aims to determine legal protection for children who are perpetrators of repeated criminal acts of sexual violence against children. So the author tries to formulate the problem of how criminal responsibility is for children who commit crimes of repeated sexual violence against children. The research method used in this research is normative legal research using the statutory regulatory approach method, conceptual approach method. The results of research regarding legal protection for children as repeat perpetrators of crimes of sexual violence, the law requires the punishment of children who are perpetrators of crimes in the serious category which carries a sentence of more than 7 years and if the child's age has reached 14 (fourteen) years. Article 415 letter b of the Criminal Code regulates criminal acts of sexual violence which stipulates that every person who commits sexual violence against another person, shall be punished with a maximum imprisonment of 9 (nine) years. So the perpetrator of a crime of morality, in this case the crime of sexual violence, is threatened with 9 (nine) years in prison for adults, however, if the perpetrator is a child, then the penalty is only half that amount. This child, as the perpetrator of the crime, is sentenced to half the sentence of an adult, namely 4.5 years. This is an implementation of Article 81 paragraph (2) of Law Number 11 of 2012 concerning the juvenile criminal justice system which can be sentenced to a child no later than ½ (one half) of the maximum penalty of imprisonment for adults. In the Law or Criminal Code regarding repetition of criminal acts there is no mention of the article on sexual violence, so if there is a repetition of a criminal act in sexual violence it is punished with the same sentence as the sentence for the article that was violated.
