Abstract

The government's obligation to protect citizens includes personal data. The protection of personal data can be found in the Population Administration Law Article 79 paragraph (1) which states that individual data and population documents must be kept and protected by citizens. However, there is negligence from the government in protecting data such as selling document archives. This incident is included in the unlawful act by the government (onrrechtmatige overheisdaad). Residents have the right to request compensation as Article 2 states that every resident has the right to obtain personal data protection and compensation due to negligence in protecting passport personal data by the implementing agency. This study uses a type of normative juridical research with a statutory approach and a conceptual approach. There are two sources and types of legal materials, namely primary legal materials using various laws and regulations and secondary legal materials using books and journal articles. The collection of legal materials is collected by categorizing according to the topic of discussion and using perscriptive normative analysis techniques. The results of this study show that the state/government can be held accountable as mentioned in the Population Administration Law and prevention efforts as well as the role of supervisory institutions in taking part in protecting citizens' personal data. The suggestion that can be given is to explicitly and clearly regulate the prohibition of the sale of personal data and clearer compensation procedures so that it can better protect the rights of citizens.
