Abstract

The aim of this research is to examine and analyze regulations regarding general election campaigns using state facilities and monitoring mechanisms to prevent misuse of state facilities in carrying out general election campaigns. This research is a type of legal research using statutory, conceptual and case approaches. The results of this research show that the campaign is one of the stages in holding general elections which is carried out in the form of two-way political communication between general election participants and voters. When carrying out a campaign, the President and Vice President, state officials and regional officials are prohibited from using state facilities. The prohibition on the President and Vice President, state officials and regional officials from using state facilities to carry out campaigns is regulated in Article 281 paragraph (1) letter a of Law no. 7 of 2017 in conjunction with Article 304 paragraph (1) Law no. 7 of 2017 in conjunction with Article 63 paragraph (3) PKPU No. 11 of 2020 in conjunction with Article 64 paragraph (3) PKPU No. 11 of 2020. The impact of using state facilities in the general election campaign caused the general election not to run according to the principles stated in Article 22E of the 1945 Constitution of the Republic of Indonesia, namely the principles of honesty and fairness. Therefore, prevention needs to be done. Prevention can be carried out by the General Election Supervisory Body by: a. identify and map potential vulnerabilities and election violations; b. coordinating, supervising, guiding, monitoring and evaluating election administration; c. coordinate with relevant government agencies; and D. increase public participation in election monitoring.
