Abstract

Domestic violence or usually abbreviated as KDRT is an event that often occurs within the family or living environment. Violence that occurs in the household is most often experienced by women or children, which is caused by the influence of various aspects of life that are unfair to women, providing opportunities and chances for violence against women to occur. Domestic Violence (KDRT) can manifest in various forms; whether physical violence or abuse, exploitation, neglect, or even sexual violence experienced by wives/husbands, children or domestic workers (PRT). Many cases of domestic violence (KDRT), whether reported or not, are actually often encountered in everyday life. In incidents of domestic violence (KDRT), there must be a perpetrator and a victim, where the victim experiences, sees and hears directly the occurrence of domestic violence (KDRT). A victim of domestic violence (KDRT) has an important role in disclosing a problem that occurs in their household so that a victim of domestic violence can also become a witness. This witness statement is very useful for the purposes of investigation, prosecution and justice regarding things experienced, heard and seen by a witness. Article 55 of Law Number 23 of 2004 concerning the Elimination of Domestic Violence regulates that as a valid form of evidence, the testimony of a victim witness alone is sufficient to prove that the defendant is guilty if accompanied by other valid evidence. The aim of this research is to determine the strength of the evidence of a witness's testimony as a victim of domestic violence and how the process of proving domestic violence stops if a victim withdraws his claim and chooses to reconcile even though a perpetrator has been proven guilty by the presence of several pieces of evidence.
