Abstract

This research discusses restitution rights for victims of rape in the Indonesian law system using normative legal research methods with a statute, case, and comparative approach. The purpose of the research is to identify forms of sexual violence, criminalization, and legal restitution rights given to victims of rape crimes. Restitution is the payment of compensation to victims as a responsibility for the losses suffered as a result of criminal acts. Rape victims often suffer serious physical and mental losses, but existing legal protection still has weaknesses in its application. Law No 12 of 2022 provides clearer provisions on restitution for victims of sexual violence crimes, including sanctions for perpetrators who won’t pay. Adequate legal support and assistance is needed to help victims overcome the impact of rape and restore justice for victims. This research is expected to strengthen the legal protection system against sexual violence, especially in the context of restitution rights for victims of rape.
