Abstract

Every year, Indonesia always experiences changes to the regulations that regulate people's behavior every year, namely what is called the Criminal Code. The Criminal Code is a set of legal regulations which specifically regulate the behavior of society in order to create a developing country that is in line with the goals of the state. Indonesia has various tribes, nations, religions, beliefs as well as races and cultures, one of which is that Indonesia upholds the differences between beliefs and religions of each of its people which is in accordance with Presidential Decree No. 1 of 1965 but there is a renewal, namely the presence of Law Number 1 of 2023. Law No1/2023 is considered controversial because there is legal uncertainty regarding the form and basis of sanctions against perpetrators of blasphemy against religion/beliefs. Criminal acts against perpetrators of blasphemy against religion/beliefs are regulated in new regulations contained in Law No. 1/2023 concerning the Criminal Code Articles 300-305 Chapter VII which will come into force in 2026, to be used as a guide for someone in expressing opinions. The aim of the research is to find out what forms of criminal action against perpetrators of blasphemy of religion/belief are based on Law No.1/2023. Using a normative juridical approach, it can be concluded what form of criminal sanctions and legal basis can be applied to perpetrators of religious blasphemy as contained in Law No.1/2023. The results of the research in this study are: Where are there limits to arguing and expressing freedom of opinion regarding religion, considering that with the presence of Law No. 1/2023 Chapter VII concerning Blasphemy of Religion/Beliefs has confirmed and explained the limits for expressing opinions and if they exceed those that have been determined by regulations, there will be sanctions in the form of imprisonment or fines.
