Abstract

This research aims to investigate the status and legal strength of money lending and borrowing agreements made orally based on applicable civil law, especially the civil code. This research uses a normative method. Normative legal research conducted by examining secondary legal materials also uses approach methods, namely the law approach and conceptual approach, which will later provide recommendations as input for law revision. Oral agreements, it is important to note that the agreement can be considered valid if it complies with the legal requirements of an agreement. Even though it is legally valid, an oral agreement still has a very high risk compared to a written agreement. Written agreements have the advantage of providing strong and clear physical evidence of the agreement between the parties involved. This is very important to determine the rights and obligations of each party, as well as providing a strong legal basis in the event of a violation or default. The legal basis for the importance of written agreements in matters of evidence and prosecution can be found in the Indonesian Civil Code (KUHP). Using a written agreement also allows parties who feel disadvantaged due to default to file a lawsuit and prove their case in court more easily.
