Abstract
This study aims to determine and explain the characteristics of illicit enrichment as a crime of corruption and to find out the judge's consideration in deciding a corruption case with case number 40/Pid.Sus-TPK/2020/PT Sby, if it is related to the concept of illicit enrichment. The research method used in this research is normative legal research using a statutory approach, conceptual approach, and case approach and using primary, secondary, and tertiary legal materials. In this research, the author will discuss the characteristics of illicit enrichment, or an increase in unnatural or unauthorized assets, as a crime of corruption characterized by a significant increase in the ownership of assets of public officials that can potentially be generated from unauthorized income, so that it opens the possibility of originating from criminal acts of corruption. Thus, self-enrichment is the most visible manifestation of corruption. Regarding the concept of illicit enrichment, it can be used as one of the basic considerations of the judge, which of course will affect the results of the judge's decision in a corruption case written in verdict number 40/Pid.Sus-TPK/2020/PT Sby. Of course, discussing more concrete cases that have been processed in Indonesia, shows that if the Indonesian legal system has an offense of illicit enrichment as a criminal offense, the handling of these cases will be maximized and will have a greater impact on the eradication of corruption in Indonesia.
