Abstract

The existence of people with disabilities has special treatment from other people. Behind the shortcomings of a person with a disability, they are literally entitled to special treatment, one of which is in the medical field. Cerebral Palsy is one of the constituents of physical disabilities. In the treatment therapy of Cerebral Palsy, Persons with Disabilities require the presence of medical cannabis as a treatment therapy used. Because cannabis is included in Narcotics Class I, Persons with Disabilities have lost hope of getting the treatment therapy used because it is prohibited from being used as a juridical treatment. The type of research method used in this research is normative legal research method. Using Legislation Approach, Conceptual Approach, and Case Approach. Using primary legal sources in the form of laws and regulations, and secondary legal sources in the form of scientific journals and books in the field of law. The results of this study are regarding the legal protection of persons with disabilities to fight for their rights again based on the written Constitution, namely the 1945 Constitution. Protection of Persons with Disabilities can be seen in Article 28H paragraph (1) of the 1945 Constitution, where Persons with Disabilities have the right to live in physical and mental prosperity and obtain health services, then the rights of Persons with Disabilities can be said to be not fulfilled. For this reason, it is necessary to take legal action. Through Constitutional Court Decision Number 106/PUU-XVIII/2020, Persons with Disabilities expect justice for their right to welfare.
