Abstract
Shopee adalah salah satu e-commerce yang tengah berkembang pesat di Indonesia. Di shopee menyediakan berbagai metode pembayaran yang salah satunya adalah cash on delivery (COD). Dalam prakteknya cash on delivery sangat menarik perhatian konsumen karena dinilai lebih aman dalam melakukan proses jual beli. Tetapi tidak sedikit konsumen yang kurang pengetahuannya terhadap sistem cash on delivery ini. Banyak konsumen yang melampiaskan kemarahannya kepada kurir karena barang yang dikirim tidak sesuai dengan pesanan. Penulisan skrpsi ini berfokus pada keabsahan perjanjian jual beli yang memuat klausula eksonerasi melalui aplikasi shopee dengan menggunakan sistem cod (cash on delivery) dan perjanjian jual beli yang memuat klausula eksonerasi melalui aplikasi shopee dengan menggunakan sistem cod (cash on delivery). Oleh karena itu, penelitian ini menggunakan metode penelitian normatif dengan menggunakan data primer dan data sekunder yang kemudian akan dianalisa menggunakan metode kualitatif dengan penarikan kesimpulan secara deduktif. Pada akhir penelitian ini, ditarik kesimpulan, satu bahwa akibat hukum atas transaksi jual beli berbasis aplikasi Shopee melalui COD, pelaku usaha memberikan ganti kerugian dan konsumen dapat melakukan upaya pengaduan, tanggung jawab pelaku usaha adalah tanggung jawab kontraktual. Perjanjian baku yang mengandung klausula eksonerasi telah diperjanjikan sebelumnya, perjanjian tersebut tidak dapat dianggap sah karena mengandung ketentuan/klausula yang bertentangan dengan undang-undang. Klausula baku menjadi tidak patut ketika kedudukan para pihak menjadi tidak seimbang karena pada dasarnya, suatu perjanjian adalah sah apabila menganut asas konsensualisme disepakati oleh kedua belah pihak- dan mengikat kedua belah pihak yang membuat perjanjian tersebut sebagai undang-undang. Dengan demikian, pelanggaran terhadap asas konsensualisme tersebut dapat mengakibatkan perjanjian antara kedua belah pihak menjadi tidak sah. Oleh karena itu, klausula baku yang mengandung klausula eksonerasi dilarang oleh hukum. (Shopee is one of the fastest growing e-commerce sites in Indonesia. Shopee provides various payment methods, one of which is cash on delivery (COD). In practice, cash on delivery is very attractive to consumers because it is considered safer in the buying and selling process. But not a few consumers who lack knowledge of this cash on delivery system. Many consumers vent their anger on the courier because the goods sent are not in accordance with the order. The writing of this thesis focuses on the validity of the sale and purchase agreement which contains an exoneration clause through the Shopee application using the COD (cash on delivery) system and the sale and purchase agreement containing an exoneration clause through the Shopee application using the COD (cash on delivery) system. Therefore, this study uses a normative research method using primary data and secondary data which will then be analyzed using qualitative methods with deductive conclusions. At the end of this study, conclusions are drawn, one that the legal consequences of buying and selling transactions based on the Shopee application through COD, business actors provide compensation and consumers can make complaints, the responsibility of business actors is contractual responsibility. A standard agreement containing an exoneration clause has been previously agreed, the agreement cannot be considered valid because it contains provisions/clauses that are contrary to the law. The standard clause becomes inappropriate when the position of the parties becomes unbalanced because basically, an agreement is valid if it adheres to the principle of consensualism agreed upon by both parties and binds both parties who make the agreement as law. Thus, a violation of the principle of consensualism can result in the agreement between the two parties being invalid. Therefore, standard clauses containing exoneration clauses are prohibited by law.)
