Abstract

Procurement of government goods/services is an activity to obtain goods/services by Ministries/Institutions/Regional Work Units/other institutions whose process starts from planning needs until completion of all activities to obtain goods/services through national development carried out by the Indonesian state. Presidential Regulation Number 12 of 2021 concerning Amendments to Presidential Regulation Number 16 of 2018 concerning Procurement of Government Goods/Services for its derivatives for construction work is the Regulation of the Minister of Public Works and Public Housing of the Republic of Indonesia No. 14 of 2020 concerning Standards and Guidelines for Procurement of Construction Services Through Providers.Prosecution towards corporations, eventhough closely related to financial. Unlawful acts in civil law are called onrechtmatige daad. The legal basis is Article 1365 of the Civil Code, which is that every act that violates the law, which brings harm to another person, obliges the person who, because of his mistake, published the loss, to compensate for the loss. The legal subjects in this research are ASN (goods users) namely Pokja, PPK and KPA in making policies in the Government PBJ Tender Process. Procedural deviations in the selection/Tender process carried out by the Goods Users are 1) a substantial error in the evaluation process. 2). deviation from the provisions and procedures regulated in Presidential Regulation Number 12 of 2021 concerning Amendments to Presidential Regulation Number 16 of 2018 concerning Procurement of Government Goods/Services and the provisions stipulated in the Bidding Document. One of the acts that harm bidders is to evaluate and determine requirements that deviate or not based on the rules that have been set, and such actions cause losses to the Participants, are categorized as Unlawful Acts with legal sanctions to compensate for material or immaterial losses to participants, in addition to compensation sanctions as well may be subject to light, moderate, or severe disciplinary sanctions, according to Presidential Regulation 12 of 2021, concerning the Procurement of Government goods and services.
