Abstract

The imposition of criminal sanctions on foreign fishing vessels that carry out illegal fishing at WPPRI does not overlap the rules that result in ineffective enforcement of fisheries law in the ZEEI area. In addition, so far there have been many fishing violations committed by foreign vessels. The formulation of the problem is: 1. How is the Law Enforcement in the Exclusive Economic Zone (EEZ) in the Context of Indonesia's National Interest in the Marine Sector? 2. How is the imposition of criminal sanctions for foreign fishing vessels committing the criminal act of fishing illegally in the Indonesian Exclusive Economic Zone (ZEEI) according to Law No. 45 of 2009 concerning Fisheries? The statutory approach is usually used to examine statutory regulations, which in normalizing there are still deficiencies or even foster deviant practices both at the technical level or in their implementation in the field. The Case Approach with the case approach is carried out by examining cases related to the issue at hand, and has become a decision that has permanent legal force. This case can be in the form of cases that occur in Indonesia or in other countries. The results of the study show that there is still inconsistency in law enforcement in the EEZ for fishery potential by the Indonesian Navy in the Exclusive Economic Zone (EEZ), Indonesia is based on the United Nations convention regarding the Law of the Sea in 1982 with Law Number 17 of 1985 concerning legalization. on the United Nations Convention on the Law of the Sea (UNCLOS) and Law Number 45 of 2009 concerning Fisheries. Illegal fishing still occurs in the Indonesian Exclusive Economic Zone by foreign vessels. Keywords: ZEEI, Law Enforcement, Fish Theft Court
