Abstract

Pada hakikatnya hukum Islam merupakan hukum modern karena sudah mengenal bentuk penyelesaian restorative justice pada jarimah qisas dan diyat . Konsep restorative justice dalam hukum pidana Islam di lakukan melalui perdamaian dan pemaafan dengan mewujudkan terciptanya keadilan dan keseimbangan bagi pelaku tindak pidana serta korbannya sendiri. Restorative justice dalam Hukum Pidana Islam diatur secara tegas dalam Q.S.al-Hujurat (49) Ayat 10 dan Q.S. Asy-Syuura (42) Ayat 40 yang memerintahkan perdamaian dan pemaafan. Dengan adanya perdamaian antara korban dan pelaku tersebut dalam rangka mewujudkan keutuhan sebagai tujuan dari hukum. Adapun tujuan yang diharapkan dari penelitian ini adalah mengetahui penerapan restorative justice dalam penyelesaian tindak pidana perspektif hukum pidana islam dan hukum yang di Indonesia. Penelitian ini merupakan penelitian hukum normatif dan pendekatan yang digunakan adalah pendekatan perundang- undangan,pendekatan konseptual dan pendekatan asas-asas hukum.Keadilan restoratif bisa berdampak positif pada sistem peradilan pidana Indonesia. Hal ini ditunjukkan dengan efektifitas penerapan restorative justice dalam sistem peradilan pidana di Indonesia yang dibuktikan dengan Surat Edaran Kapolri Nomor SE/8/VII/2018 tentang Penerapan Restorative Justice, Undang-Undang Nomor 11 Tahun 2018, 2012 tentang Sistem Peradilan Pidana Anakdan Peraturan Kejaksaan Nomor 15 Tahun 2020 tentang Pemutusan Perkara Pidana. Selanjutnya berdasarkan Restorative Justice memungkinkan proses peradilan yang cepat, mudah, efektif dan efisien.
