Abstract

The author's purpose of conducting this research is to understand the provisions of legal protection for consumers of online loan services and find out the legal settlement efforts obtained by online loan consumers regarding legal problems experienced by the community. The author in this study examines various existing policies (normative). The results of the discussion show that legal protection for online loans is still lacking due to limited information technology literacy for consumers, this limitation causes consumers not to think about the dangers of borrowing easily offered from various financial services. So it is necessary to conduct a study on information literacy between the borrower and the lender (online-based financial service entrepreneur), literacy in the form of Information Technology knowledge described according to article 26 is that online loan service entrepreneurs (loans) have an obligation to maintain integrity, confidentiality, and availability. than consumer data since the data was obtained until the data was destroyed. . Sanctions given to organizers in relation to personal data violations refer to Article 47 paragraph (1), namely: Giving written warnings, paying a certain amount of money (fines), and limiting business or activities to the revocation of business licenses. And it is reaffirmed in Law No. 19 of 2016 (amendment to Law No. 11 of 2008) regarding Information and Transactions which contains articles regarding the provision of protection for consumers of online loan services (pinjol), namely Article 45 paragraph (3) . In addition, there is a need for cooperation between the Ministry of Communication and Information of the Republic of Indonesia, the Financial Services Authority and the authorities in conducting supervision and increasing public digital literacy
