Abstract
Technological progress has not been clearly regulated in the Criminal Procedure Code. With the era of modern technology, there has been a renewal of the Criminal Procedure Code. and its importance is increased to the Criminal Procedure Code. the new one. This is also important not only for material law and formal law in criminal procedural law. Advances in information and communication technology that have led to the development of modern transactions through electronic media are not followed by legal developments, especially formal law, which should be able to keep up with the accelerated development of current technological applications. The formulation of the problem is: 1. The essence of electronic evidence in criminal procedural law. 2. The concept of regulating Electronic evidence in procedural law criminal. The research methodology used is a legal approach, a case approach, a comparative approach and a philosophical approach. The results show that the legal position of electronic evidence has been clarified in CHAPTER III concerning Information, Documents, and Electronic Signatures in Article 5, Article 6, and through reaffirmation in Article 44 of Law Number 11 of 2008 concerning Electronics. Information and Transactions as amended by Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions. Future concepts related to electronic evidence, in the future need to be integrated and discussed and studied in an integrated manner in the Draft Criminal Procedure Code which contains at least two valid pieces of evidence from electronic evidence.
