Abstract

Corona Virus Disease (Covid-19) must be admitted to have caused various problems from social, economic to legal aspects. One of the steps taken by the Indonesian government in dealing with this pandemic is the published of Presidential Decree No. 12 of 2020 abaout the Determination of the Non Nature Covid-19 Disaster as a National Disaster and followed by the Law No. 21 of 2020 abaout Large-Scale Social Restrictions for the Acceleration of Handling Covid- 19 which in the end raises legal implications, especially on legal agreement because it hinders the ability of the debtor to fulfill the achievements in an agreement so that it can be used as a legal basis that the debtor experiences a force majeure. The approach method used in this research is normative legal research, which is a study that primarily examines legal regulations, legal principles and legal theory / doctrine. This research was also carried out using a statue approach and a conceptual approach, which is related to the legal position of Presidential Decree No.12 of 2020 and the legal implication cause by that. By using the hardship principle, the implication of the Presidential Decree No.12 of 2020 to contract law will be minimize the legal implications for both party in the Covid-19 pandemic Keywords: Covid-19, Force Majeure, Contract
