Abstract

The development of social media has changed the way consumers express their opinions about a product, where reviews posted openly on social media have become an important factor in influencing purchasing decisions. Product reviews not only serve as a means of sharing experiences and information, but also have the potential to cause legal disputes, especially if the reviews are negative and can harm businesses. Consumers also often face legal pressure even though the reviews are based on real experiences. This situation shows that there is an imbalance in legal protection and no clear boundaries regarding the scope of reviews that are allowed on social media. This study aims to analyze the form of legal protection for consumers in reviewing business actors' products on social media and whether consumers can be held legally liable if their reviews harm business actors. The research method used is normative legal research using two approaches, namely the legislative approach and the conceptual approach to analyze the relevant legal provisions. The results of the study show that consumers have the right to review business actors' products in accordance with the provisions of Article 4 letter d of Law Number 8 of 1999 concerning Consumer Protection and are entitled to legal protection for the reviews they make, both in the form of preventive legal protection in the form of guidance and digital literacy education and repressive legal protection in the form of dispute resolution through BPSK, LPKSM and BPKN. Consumers may also be held civilly liable under Article 1365 of the Civil Code in the form of compensation for damages and criminally liable if their reviews contain elements of defamation or libel under Article 27A of Law Number 1 of 2024 concerning Electronic Information and Transactions.
