Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis perlindungan hukum terhadap anak dalam penerbitan Surat Keterangan Catatan Kepolisian (SKCK) berdasarkan peraturan perundang-undangan di Indonesia. Skripsi ini berjudul “Perlindungan Hukum Terhadap Anak Dalam Penerbitan Surat Keterangan Catatan Kepolisian”. Metode penelitian menggunakan Metode Penelitian Hukum Normatif dengan menggunakan pendekatan Undang-undang (statute approach) dan pendekatan konseptual (conseptual approach). Rumusan Masalah yang dibahas adalah : (1) Bagaimana pengaturan hukum perlindungan anak dalam penerbitan Surat Catatan Kepolisian (SKCK) menurut hukum di Indonesia?, (2) Apakah penerbitan Surat Catatan Keterangan Kepolisan (SKCK) memberikan jaminan perlindungan atas kerahasiaan data terhadap kenangan masa lalu anak dalam penerbitan Surat Keterangan Catatan Kepolisian?. Dari pendekatan tersebut dihasilkan bahwa rumusan masalah yang pertama akan membahas mengenai pengaturan hukum perlindungan anak dalam penerbitan surat keterangan catatan kepolisian menurut hukum di indonesia. Sedangkan untuk rumusun masalah yang kedua akan membahas jaminan perlindungan atas kerahasiaan data terhadap kenangan masa lalu anak dalam penerbitan Surat Keterangan Catatan Kepolisian terhadap anak terkait dengan hak hak anak yang pernah berkonflik dengan hukum. Penelitian ini diharapkan dapat memberikan kontribusi bagi pengembangan hukum pidana serta pemahaman yang lebih mendalam mengenai pencatatan kriminal anak dalam surat keterangan catatan kepolisian yang tidak ada pembeda antara usia anak dan usia dewasa.
