Abstract

This study is entitled “Ratio Legis of the Imposition of Zero Penalties for Corruption Crimes.” This study aims to examine the ratio legis of Article 131 of Law Number 1 of 2023 and analyze the suitability of imposing zero penalties with the principles of punishment in criminal law, particularly in relation to corruption crimes. The focus of this study lies in situations where a person has been convicted of a crime but then commits another crime before the judge's decision. This condition indicates the existence of a concursus of offenses that are processed separately, known as deferred crimes, so that these deferred crimes have the potential to be punished with zero penalties. This study uses a normative legal method with a legislative, conceptual, and case study approach. The results of the study show that the basis for the consideration of Article 131 of Law Number 1 of 2023 is based on the principles of proportionality, effectiveness of law enforcement, and protection of the ne bis in idem principle, as well as providing room for individualization of punishment. The application of a zero sentence is considered to be in line with the objectives of punishment as long as it is applied selectively in situations where the imposition of additional penalties no longer provides legal benefits, but still affirms the defendant's guilt through a guilty plea.
