Abstract

Mental disorders, particularly paranoid schizophrenia, present significant legal challenges in determining criminal responsibility, as the mental condition of the offender may affect their ability to distinguish right from wrong. Under Indonesian criminal law, Article 44 of the Criminal Code (KUHP) provides an exception to criminal liability for offenders who are unable to act consciously due to mental defects or illness. Therefore, clear analysis is required to understand how the legal system addresses offenders with a history of paranoid schizophrenia. This research aims to examine the legal process, the mechanism of criminal responsibility, and the role of the legal system in balancing public interest with the individual rights of offenders suffering from mental disorders. The study employs normative legal research using statutory, conceptual, and case approaches, supported by primary, secondary, and tertiary legal materials. The findings reveal that the capacity to be held responsible constitutes a central element in establishing guilt. Visum et Repertum Psychiatricum and expert psychiatric testimony serve as crucial evidence to assess the causal relationship between an offender’s mental condition and their actions. Judges retain discretionary authority in evaluating the weight of such evidence, which may lead to disparities in judicial decisions. The dual-track system under Article 44 of the Criminal Code allows a combination of punitive sanctions and rehabilitative measures for offenders proven unable to assume criminal responsibility. In conclusion, criminal responsibility for offenders with paranoid schizophrenia must be determined through objective medical and legal assessments. This study recommends the establishment of national standards for psychiatric examinations, technical guidelines for law enforcement, and strengthened rehabilitative approaches to ensure substantive justice and the protection of human rights.
