Abstract

Konsep negara hukum yang dianut Indonesia menempatkan hukum sebagai landasan tertinggi dalam penyelenggaraan negara, yang berfungsi membatasi kekuasaan dan menjamin tegaknya prinsip keadilan, kepastian, serta kemanfaatan hukum dalam sistem hukum Indonesia, putusan hakim yang telah berkekuatan hukum tetap pada prinsipnya memiliki kekuatan mengikat dan dianggap benar sesuai asas res judicata pro veritate habetur. Lahirnya putusan pengadilan yang telah berkekuatan hukum tetap pada dasarnya mengandung kekuatan mengikat, baik secara formil maupun materiil. Namun, problem hukum muncul ketika putusan tersebut terkualifikasikan yang merupakan hasil dari tindak pidana suap dan gratifikasi, sehingga menimbulkan konflik antara asas kepastian hukum dengan prinsip keadilan substantif. Penelitian ini bertujuan untuk menganalisis akibat hukum terhadap putusan inkracht hasil tindak pidana suap dan gratifikasi, serta merumuskan konsep pengaturan dan pengawasan hakim dalam konteks tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Bahan hukum primer berupa peraturan perundang-undangan terkait kekuasaan kehakiman dan pemberantasan tindak pidana korupsi, sedangkan bahan hukum sekunder berasal dari literatur, jurnal, dan penelitian terdahulu. Hasil penelitian menunjukkan bahwa hukum positif Indonesia belum memberikan mekanisme yang jelas mengenai pembatalan atau koreksi terhadap putusan inkracht yang lahir dari praktik suap dan gratifikasi. Kondisi ini menimbulkan kekosongan hukum (legal gap) yang berdampak pada integritas lembaga peradilan dan kepercayaan publik. Oleh karena itu, diperlukan pembaruan kebijakan hukum pidana yang secara eksplisit mengatur mekanisme pembatalan putusan hasil tindak pidana suap dan gratifikasi, sekaligus memperkuat sistem pengawasan hakim untuk menjamin independensi, integritas, dan akuntabilitas peradilan.
