Abstract

Legal issues in land sales practices in Indonesia are increasingly complex, one of which is related to the sale of land that is still burdened with mortgage rights without the knowledge or consent of the creditor. This study aims to examine the form of legal responsibility for actors who sell land with the status of still being bound by mortgage rights, as well as the form of legal protection for buyers who have carried out the transaction in good faith. This study uses a normative legal approach with a literature study method, in which primary legal materials such as the Criminal Code and the Mortgage Law are analyzed systematically and conceptually. The results of the study indicate that sellers who hide the mortgage status of the land being sold can be subject to civil, criminal, and administrative liability. Criminally, the perpetrator can be subject to sanctions based on Article 378 of the Criminal Code concerning fraud and Article 372 of the Criminal Code concerning embezzlement. From a civil aspect, buyers can file a lawsuit for breach of contract or unlawful acts, demand compensation, and cancellation of the sale and purchase agreement. Legal protection for buyers in good faith is realized through the right to restitution, cancellation of deeds, and restoration of rights for losses due to legally flawed transactions. The conclusion of this study emphasizes the importance of caution in every land transaction and the need to verify the legal status of the land before the sale and purchase is carried out. This study is expected to be a reference for the community, legal practitioners, and the government in responding to and resolving similar problems in the future.
