Abstract

Identitas pribadi pasien yang identitasnya melekat pada pribadi pasien. Identitas pribadi pasien merupakan data identifikasi yang dihubungkan dengan pasien melihat adanya hubungan hukum yang terjadi antara pasien dan dokter sebagai petugas kesehatan yang menimbulkan hak dan kewajiban antara para pihak. Tata pribadi pasien digunakan untuk mengidentifikasi seseorang baik secara langsung maupun tidak langsung sesuai dengan undang-undang nomor 27 tahun 2022 mengenai perlindungan tetapi bagi pasien diartikan sebagai dan informasi yang berhubungan dengan individu yang telah dikenali atau dapat dikenali secara langsung maupun tidak langsung, tenaga medis atau tenaga kesehatan adalah profesi yang diatur secara rinci oleh undang-undang nomor 17 tahun 2023 tentang pengembangan dan pemberdayaan tenaga kesehatan. Tenaga medis memiliki tugas yang sangat besar dan penting dalam memberikan pelayanan kesehatan, rekam medis merupakan berkas atau dokumen penting bagi setiap instansi rumah sakit rekam medis mencangkup aspek keakuratan, keamanan, dan kerahasiaan data pasien. Selain itu rekam medis memiliki nilai hukum yang sangat penting berfungsi sebagai bukti dalam tindakan medis dan sebagai sarana perlindungan hak-hak pasien sebagaimana yang diatur dalam undang-undang nomor 24 Tahun 2022 tentang rekam medis. Hubungan hukum antara dokter dengan pasien telah terjadi sejak dahulu dokter sebagai seorang yang memberikan pengobatan terhadap orang yang membutuhkannya pasien rumah sakit merupakan konsumen sehingga secara umum pasien yang dilindungi dengan undang-undang nomor 8 tahun 1999 tentang perundingan konsumen menurut pasal 4 undang-undang nomor 8 tahun 1999 hak-hak konsumen atas kenyamanan keamanan dan keselamatan dalam mengkonsumsi barang atau jasa. Perlindungan hukum pasien berdasarkan preventif hukum perlindungan konsumen di Indonesia secara keseluruhan mengikuti peraturan perundang-undangan nomor 8 tahun 1999 tentang perlindungan konsumen mengenai konsumen dan kesehatan yang berkaitan dengan pelayanan kesehatan terhadap pasien terutama pelayanan yang diberikan oleh rumah sakit.
