Abstract

Penelitian ini bertujuan untuk mengetahui dan memahami pengelolaan royalti hak cipta dan perlindungan hukum terhadap royalti hak cipta lagu bagi pencipta musik di Indonesia, khususnya dalam konteks maraknya pelanggaran melalui platform digital Tiktok. Dengan menggunakan metode penelitian normatif, penelitian ini mengkaji pengelolaan royalti, pengaturan hak moral dan hak ekonomi pencipta lagu berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan Peraturan Pemerintah Nomor 56 Tahun 2021. Hasil penelitian menemukan bahwa pengelolaan royalti secara kolektif diawasi serta dikoordinasikan oleh LMK dan LMKN sesuai dengan ketentuan dalam Pasal 89 Undang-Undang Nomor 28 Tahun 2014 dan dalam Pasal 12, Pasal 13, dan Pasal 14 Peraturan Pemerintah Nomor 56 Tahun 2021, sementara itu perlindungan hukum bagi pencipta lagu berupa gugatan ganti rugi serta penghentian penggunaan karya, baik melalui jalur perdata maupun pidana sesuai dengan ketentuan dalam Pasal 96, Pasal 97, dan Pasal 99 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta.
