Abstract

Penelitian ini bertujuan untuk mengetahui dan memahami bentuk perlindungan hukum terhadap pemain dalam transaksi top up game online, tanggung jawab hukum perusahaan pengembang seperti Hoyoverse atas kerugian yang dialami konsumen, serta mekanisme ganti rugi bagi pemain yang dirugikan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap konsumen digital telah diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK), Kitab Undang-Undang Hukum Perdata (BW), serta Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP). Namun, ketentuan Terms of Service Genshin Impact yang menunjuk hukum Singapura sebagai dasar penyelesaian sengketa menimbulkan ketimpangan posisi tawar dan berpotensi bertentangan dengan asas keadilan dan perlindungan konsumen di Indonesia. Pemain yang mengalami kerugian memiliki hak untuk menuntut ganti rugi baik melalui jalur perdata, pidana, maupun mekanisme penyelesaian sengketa konsumen sebagaimana diatur dalam peraturan perundang-undangan. UUPK telah memberikan dasar hukum dan mekanisme penyelesaian yang dapat digunakan oleh konsumen untuk memperoleh keadilan. Penelitian ini merekomendasikan adanya penguatan regulasi dan pengawasan terhadap transaksi digital, serta penyesuaian terhadap klausul baku dalam kontrak layanan digital oleh pelaku usaha asing demi perlindungan yang adil bagi konsumen Indonesia.
