Abstract

This study discusses legal protection for creditors who hold debt collateral in the form of Building Use Rights (HGB) that has expired. In banking practice, HGB is often used as collateral in credit agreements, but problems arise when the HGB expires before the debt is paid off. This creates legal uncertainty and potential losses for creditors because the collateral object reverts to the state, so that the creditor's rights are not legally protected. The purpose of this study is to analyze the form of legal protection that can be given to creditors and the legal consequences of the expiration of HGB as an object of debt collateral. This study uses a normative legal approach with a statutory and conceptual approach method. The legal materials used consist of primary legal materials such as laws and government regulations and secondary legal materials from legal literature. The results of the study show that although the mortgage right on HGB provides a priority position for creditors, legal protection is only effective as long as the HGB is still valid. Therefore, preventive efforts such as including the obligation to extend the HGB in the credit agreement, as well as conducting periodic monitoring of the validity period of the HGB are very important. Meanwhile, the form of repressive protection can be in the form of a lawsuit or execution of mortgage rights in the event of default. Thus, banking regulations and practices are needed that are able to provide certainty and legal protection that ensures protection for creditors in facing legal risks due to the expiration of the HGB validity period.
