Abstract

Adanya penelitian ini bertujuan untuk mengetahui perlindungan hukum dan bentuk tanggung jawab pelaku usaha terhadap konsumen rokok elektrik yang tidak mencantumkan label informasi dan peringatan Kesehatan pada kemasannya, dilatarbelakangi dengan maraknya transaksi rokok elektronik yang dijual secara bebas oleh pelaku usaha. Kurangnya Informasi dari pelaku usaha dan tidak tercantumnya label informasi yang jelas dalam pembelian rokok elektrik yang menyesatkan konsumen. Dengan adanya hal itu, maka timbul beberapa permasalahan yaitu mengenai perlindungan hukum bagi konsumen, perlindungan Kesehatan bagi konsumen sampai sanksi pidana , hal tersebut ditujukan bentuk tanggung jawab pelaku usaha terhadap konsumen rokok elektrik yang tidak mencantumkan label peringatan kesehatan pada kemasannya. Hasil penelitian ini menunjukan perlindungan hukum bagi konsumen rokok elektrik terhadap pelaku usaha rokok elektrik yang tidak mencantumkan label peringatan Kesehatan pada kemasannya yaitu dapat ditemui dalam beberapa undang-undang seperti UU No 8 Tahun 1999 tentang Perlindungan Konsumen, UU No 17 Tahun 2023 tentang Kesehatan, bahkan jika melanggar akan mendapatkan sanksi pidana. Bentuk tanggung jawab pelaku usaha rokok elektrik yang tidak mencantumkan label informasi dan peringatan Kesehatan pada kemasannya antara lain memberikan garansi produk, mengganti kerugian yang diderita konsumen, dan disarankan kepada pemerintah untuk melakukan pengawasan dan pengendalian terkait peredaran rokok elektrik dan perlu secepatnya adanya langkah hukum dari pemerintah, terkait keberadaan rokok elektrik di Indonesia.
