Abstract

Pengulangan tindak pidana merujuk pada tindakan seseorang yang sudah melaksanakan tindak pidana sebelum itu, menjalankan hukuman, dan selanjutnya untuk jangka waktu tertentu kembali melaksanakan tindak pidana yang sama. Pada UU Sistem Peradilan Pidana Anak No. 11/ 2012 , pengulangan tindak pidana memiliki makna penting dan substansial dalam penegakan hukum terhadap anak. Undang-Undang SPPA menekankan prinsip keadilan restoratif dan diversi agar melindungi anak dari pengaruh negatif yang disebabkan oleh sistem peradilan pidana. Namun, ketentuan tentang pengulangan tindak pidana pada UU ini hak anak terbatasi dalam penyelesaian kasus di luar pengadilan, terutama bagi mereka yang terlibat dalam mengulang tindak pidana. Pada Pasal 7 Ayat (2) huruf b, menyatakan jika anak yang melaksanakan tindakan pidana secara berulang tidak dapat menyelesaikan perkara melalui diversi, padahal pengulangan belum tentu bisa disebut sebagai recidive. Diversi bertujuan supaya anak terhindari proses hukum yang rumit. Penelitian ini dengan tujuan agar diketahui dan penganalisisan makna pengulangan tindakan pidana pada UU SPPA Pasal 7 ayat (2) huruf b, serta bagaimana implementasinya dalam praktek peradilan pidana anak. Penelitian ini bermetode penelitian hukum normatif melalui pendekatan perundangan dan konseptual. Hasil pembahasan yang diperoleh yaitu terkait makna pengulangan tindak pidana dalam UU SPPA, dan bagaimana bentuk perlindungan hukumnya serta diversi yang memiliki berbagai pertimbangan sebelum dilaksanakan yang bertujuan melindungi hak-hak anak dengan tetap memberikan efek jera.
