Abstract

Pencemaran lingkungan merupakan ancaman serius terhadap ekosistem dan hak masyarakat atas lingkungan yang sehat. Penelitian ini mengkaji prinsip strict liability dalam Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup (UUPPLH) yang memberikan kemudahan bagi korban pencemaran untuk menuntut ganti rugi tanpa memerlukan pembuktian kesalahan. Namun, perubahan dalam Pasal 88 UUPPLH melalui Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja mengembalikan pendekatan liability based on fault, yang mengharuskan korban membuktikan kesalahan pelaku. Penelitin ini menggunakan metode penelitian normative dengan pendekatan peraturan perundang- undangan serta pendekatan konseptual. Penelitian ini menemukan bahwa perubahan tersebut memperberat beban korban, mempersulit akses terhadap keadilan, dan mengurangi efektivitas penegakan hukum lingkungan. Dengan demikian, diperlukan revisi kebijakan yang mengutamakan perlindungan hukum bagi korban pencemaran lingkungan, serta mekanisme yang lebih adil dan efisien untuk menuntut tanggung jawab pelaku. Penelitian ini memberikan kontribusi teoritis dan praktis dalam memahami tantangan serta solusi hukum dalam perlindungan lingkungan di Indonesia.
