Abstract

Pemindahan Ibu Kota Negara ke Nusantara di Kalimantan Timur melalui Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara (UU IKN) menghadirkan tantangan hukum terkait periodesasi masa jabatan Kepala dan Wakil Kepala Otorita IKN. Berdasarkan Pasal 10 ayat (1) Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara (UU IKN), menyebutkan bahwa masa jabatan Kepala dan Wakil Kepala Otorita adalah lima tahun dan dapat diperpanjang, namun tidak ada ketentuan yang membatasi jumlah periode masa jabatan Kepala dan Wakil Otorita IKN. Mekanisme penunjukan langsung oleh Presiden tanpa pengaturan batas maksimal periode jabatan menimbulkan pertanyaan mengenai peraturan periodesasi masa jabatan Kepala dan Wakil Kepala Otorita Ibu Kota Nusantara (IKN) terhadap prinsip-prinsip hukum di Indonesia. Penelitian ini juga menganalisis mengenai Akibat Hukum dengan Tidak Adanya Peraturan Periodesasi Masa Jabatan Kepala dan Wakil Otorita IKN. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan konseptual untuk menganalisis implikasi hukum dari ketiadaan batas periodesasi tersebut. Hasil penelitian menunjukkan bahwa ketiadaan pengaturan dapat berimplikasi pada potensi kepemimpinan otoriter, ketidakstabilan hukum, dan bertentangan dengan prinsip kedaulatan rakyat. Penelitian ini menyarankan penyusunan peraturan tambahan yang lebih komprehensif untuk menjamin legitimasi, akuntabilitas, dan transparansi dalam pemerintahan khusus IKN.
