Abstract

Domestic Workers (PRT) in Indonesia have a major contribution in supporting the economic sustainability and social life of society. However, their existence is often overlooked in legal regulations that should provide proper protection and recognition. The absence of specific laws regulating the rights and obligations of domestic workers creates significant legal gaps, leaving many domestic workers at risk of exploitation, discrimination and even violence. The government is working on regulations to guarantee protection for domestic workers through Ministerial Regulation Number 2 of 2015, but these regulations are not enough to regulate the rights and protection of domestic workers. This research aims to examine regulations regarding domestic workers, with a focus on analyzing weaknesses in current regulations as well as recommendations for establishing more inclusive and fair policies. So in this research there is problem formulation one, namely how to regulate the law regarding domestic workers, and problem formulation two, how is the legal protection for domestic workers. So to what extent are existing legal regulations able to protect domestic workers and what steps need to be taken to increase this protection. This research uses a normative juridical method, with a statutory and conceptual approach. The data used includes primary legal materials, such as applicable laws, and secondary legal materials in the form of related literature, which are analyzed qualitatively to obtain an in-depth understanding. The research results show that legal protection for domestic workers is very limited. Domestic workers are not recognized as formal workers, so they do not receive basic rights such as minimum wages, decent working hours and access to social security. For this reason, it is necessary to establish a special law regulating domestic workers, to ensure their justice and welfare. These legal arrangements must include protection against harassment, exploitation and other injustices.
