Abstract

Institusi Pendidikan sebagai tempat berlangsungnya sebuah proses pendidikan, mensyaratkan ijazah bisa diambil apabila telah memenuhi semua syarat, salah satunya persyaratan keuangan. Tingginya biaya pendidikan tidak seimbang dengan pendapat orang tua siswa. Usaha per dalam memnimalisir retensi ijazah atas syarat keuangan dengan menciptakan bantuan pendidikan berupa kartu Indonesia pintar, namun pada kenyataannya program ini belum bisa berjalan maksimal. Ijazah tidak bisa diambil sama saja dengan meretensi ijazah. Apabila Institusi Pendidikan tidak memperbolehkan siswa mengambil ijazah dengan persyaratan keuangan sama halnya institusi pendidikan tersebut telah melakukan retensi ijazah siswa. Pentingnya perlindungan hukum bagi siswa diartikan sebagai usaha atau upaya yang memiliki tujuan untuk memberikan rasa dan nyaman kepada setiap warga negara. Di Indonesia praktik tidak bisa mengambil ijazah karena persyaratan keuangan sudah sering terjadi. Persyaratan keuangan menjadi syarat utama ijazah tidak bisa diambil oleh siswa. Tindakan institusi pendidikan yang tidak memperbolehkan siswa mengambil ijazah atas persyaratan keuangan termasuk dalam pelanggaran, hal ini mengakibatkan siswa tidak bisa melanjutkan pendidikan menuju jenjang lebih tinggi atau melamar pekerjaan. Penulisan penelitian ini bertujuan untuk mengenalisis serta memberikan pandangan mengenai perlindungan hukum terhadap siswa akibat retensi ijazah oleh institusi pendidikan. Metode penelitian yang digunakan penulis dalam penulisan ini menggunakan metode penelitian normatif yaitu dengan memanfaatkan data kepustakaan yang merujuk pada Undang-undang, buku, artikel, jurnal, dan penelitian�peneliitian yang memiliki relevansi dengan pokok permasalahan yang akan dibahas. Hasil penlitian ini menunjukkan bahwa perlindungan hukum berperan penting bagi siswa dalam upaya mendapatkan ijazahnya kembali.
