Abstract

This study aims to determine the legal protection for consumers who experience food poisoning and the chef who processes the food becomes the perpetrator of the crime, and to determine the form of the chef's responsibility towards consumers who experience food poisoning. Food poisoning caused by chef's mistakes can cause significant losses to consumers, both physically and materially. This study aims to examine in depth the criminal liability that can be imposed on the chef in this case. The analysis includes a study of various types of crimes that may be applied, such as negligence, neglect of obligations, or even more serious crimes. In addition, this study also discusses the elements that must be proven in the criminal case, as well as the obstacles that are often faced in the law enforcement process. Cases of food poisoning caused by chef's mistakes often raise debates about who should be held responsible. This study provides a clear picture of the chef's criminal liability in this context. The results of the study are expected to contribute to law enforcement in the food sector, as well as provide better legal protection for consumers.With clear regulations and consistent supervision from the health service, it is hoped that incidents of food poisoning can be minimized, so that consumer safety can be more assured.
