Abstract
Tujuan dilakukannya penelitian hukum ini yaitu untuk menganalisis lebih dalam mengenai penyelesaian hukum terhadap kegagalan klaim dalam asuransi jiwa dengan berfokus pada permasalahan yang sering dihadapi oleh tertanggung atau pemegang polis dalam proses pengajuan klaim asuransi. dalam hal asuransi jiwa, klaim merupakan permintaan resmi yang diajukan oleh tertanggung kepada perusahaan asuransi untuk mendapatkan kompensasi sesuai ketentuan polis. Tetapi masih banyak klaim yang ditolak disebabkan oleh ketidakpahaman tertanggung mengenai syarat dan ketentuan yang berlaku. Terdapat 3 (tiga) pendekatan yang digunakan dalam penelitian ini, yaitu Pendekatan Perundang- undangan, Pendekatan konseptual dan Pendekatan kasus. Sumber bahan hukum yang digunakan adalah bahan hukum primer dan sekunder. Teknik pengumpulan bahan hukum primer dengan menginventarisasi dan mengkategorisasi perundang-undangan sedangkan sekunder dengan studi kepustakaan. Penelitian ini mengidentifikasi faktor-faktor penyebab kegagalan klaim, termasuk kelengkapan dokumen, Ketidakjujuran dalam memberikan informasi atau kegagalan perusahaan asuransi dalam memenuhi kewajibannya menciptakan kerugian hukum dan material bagi pihak yang dirugikan. Selain itu, penelitian ini juga menguraikan prosedur hukum yang dapat ditempuh oleh tertanggung dalam menyelesaikan sengketa klaim, baik lewat jalur litigasi ataupun non- litigasi. Dari hasil penelitian yang telah dilakukan Penulis, dapat disimpulkan bahwa Dengan pemahaman yang lebih baik mengenai hak dan kewajiban dalam polis asuransi, diharapkan agar calon tertanggung dapat mengurangi risiko kegagalan klaim dan memaksimalkan perlindungan yang diberikan oleh asuransi jiwa. Temuan ini menunjukkan pentingnya edukasi dan transparansi dalam industri asuransi untuk meningkatkan kepercayaan masyarakat terhadap produk asuransi.
