Abstract

Kemajuan pesat teknologi informasi dan komunikasi telah secara mendalam memengaruhi berbagai aspek kehidupan manusia, termasuk sektor perdagangan, yang kini berkembang menjadi platform digital yang umum dikenal sebagai e-commerce. Di Indonesia, e-commerce telah mengubah perilaku konsumen dan menciptakan peluang signifikan, terutama bagi Usaha Mikro, Kecil, dan Menengah (UMKM), memungkinkan mereka menjangkau pasar yang lebih luas tanpa memerlukan infrastruktur fisik yang ekstensif. Namun, pertumbuhan pesat ini juga menghadirkan tantangan baru, terutama terkait praktik monopoli oleh platform dominan seperti Shopee. Melalui strategi integrasi vertikal, Shopee telah memperluas jangkauannya ke sektor logistik dengan Shopee Express, yang memungkinkannya untuk mengontrol proses logistik secara langsung. Meskipun integrasi ini dapat meningkatkan efisiensi, hal ini juga menghadirkan tantangan kompetitif bagi penyedia logistik pihak ketiga dan berpotensi membatasi pilihan konsumen. Penelitian ini menggunakan pendekatan penelitian hukum normatif untuk mengkaji dugaan pelanggaran Pasal 19 dan 25 Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat, khususnya terkait praktik Shopee melalui Shopee Express. Temuan menunjukkan bahwa pendekatan Shopee dapat membatasi akses pasar bagi penyedia logistik lain, menciptakan lingkungan yang menghambat persaingan dan merugikan pilihan konsumen. Pengenalan pakta integritas antara Shopee dan Komisi Pengawas Persaingan Usaha (KPPU) menjadi langkah penting dalam mengatasi ketidakseimbangan kompetitif ini. Penelitian ini menyimpulkan dengan rekomendasi untuk pengawasan regulasi yang lebih kuat oleh KPPU guna menegakkan praktik yang adil serta penekanan pada peningkatan kesadaran konsumen.
