Abstract

Penyimpanan minuta akta merupakan salah satu kewenangan yang dimiliki oleh Notaris, yang bertujuan untuk menjaga keabsahan, keaslian, dan keberlanjutan dokumen hukum. Minuta akta adalah salinan asli akta yang dibuat oleh notaris dan wajib disimpan dalam protokol notaris sesuai dengan peraturan perundang-undangan yang berlaku. Proses penyimpanan ini diatur dalam Undang-Undang Jabatan Notaris (UUJN) yang mengharuskan notaris untuk menjaga kerahasiaan, keamanan, dan ketersediaan minuta akta sebagai bentuk pertanggungjawaban profesional. Penelitian ini mengkaji aspek hukum, teknis, dan proses penyimpanan minuta akta, serta tantangan yang dihadapi dalam era digital, termasuk penyimpanan secara elektronik. Maka dalam hal tersebut penulis merumuskan permasalahan yaitu Tanggung jawab notaris terhadap kerahasiaan klien dalam penyimpanan minuta Akta. dan Bagaimana tanggung jawab notaris terhadap perlindungan data pribadi klien dalam penyimpanan akta Notariil secara elektronik. penelitian ini diharapkan dapat memberikan manfaat dalam ilmu hukum terutama dalam hukum perdata . Untuk menjawab permasalahan peneliti menggunakan pendekatan yaitu Undang-Undang yang berlaku serta pendekatan secara yuridis normatif. Hasil penelitian ini menunjukkan. Penyimpanan minuta akta diatur dalam Pasal 16 ayat (1) huruf b UUJN, yang mewajibkan notaris menyimpan minuta akta dalam Protokol Notaris. Protokol Notaris adalah kumpulan dokumen yang harus dijaga oleh notaris sebagai arsip resmi. Penyimpanan ini bertujuan untuk, menjamin keaslian dokumen, minuta akta yang disimpan memungkinkan pembuktian jika suatu saat diperlukan dalam proses hukum, melindungi kepentingan para pihak, bahwa penyimpanan yang efektif memerlukan pemenuhan standar prosedural, pemanfaatan teknologi, dan kepatuhan terhadap regulasi untuk memastikan dokumen tetap terlindungi dan dapat diakses saat diperlukan. sehingga standard keamanan untuk penyimpanan akta notariil terkonsep sedemikian rupa, Undang-Undang No. 1 Tahun 2024 tentang Perubahan kedua atas undang-undang nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik , telah mengatur berbagai aspek mengenai pemrosesan data pribadi secara elektronik. Dalam konteks akta notariil, terdapat beberapa hal penting yang perlu diperhatikan, Pengumpulan dan Penyimpanan Data Notaris dalam menjalankan tugasnya mengumpulkan data pribadi untuk dibuatkan akta notariil, seperti nama, alamat, identitas, dan data pribadi lainnya. Sesuai dengan UU Perlindungan Data Pribadi (UU PDP) yang juga menjadi bagian dari upaya menjaga keamanan data pribadi, data tersebut harus disimpan dengan aman.
