Abstract

Penelitian ini bertujuan untuk mengetahui apakah alasan menolak mutasi menjadi dasar Pemutusan Hubungan Kerja Menurut Undang-Undang Nomor 13 tentang Ketenagakerjaan dan Peraturan Pemerintah Nomor 35 Tahun 2021 tentangPerjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat, danPemutusan Hubungan Kerja, menganalisis hak-hak pekerja dalam konteks PHK,menganalisi ratio decidendi hakim Putusan No. 68/Pdt.Sus-PHI/2023/PN Pbr.Metode penelitian yang digunakan adalah pendekatan normatif dengan analisisterhadap peraturan perundang-undangan yang berlaku dan putusan pengadilanterkait. Kasus yang menggambarkan keadaan mutasi sepihak adalah pada kasusRubianto melawan PT. Eluan Mahkota, dimana dalam putusan hakim padaPengadilan Hubungan Industrial pada Pengadilan Negeri Pekanbaru dengan PutusanNo. 68/Pdt.Sus-PHI/2023/PN Pbr, Hasil penelitian menunjukan Menurut Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, pemutusan hubungan kerja(PHK) dapat dilakukan dengan alasan yang diatur secara jelas, termasuk alasan-alasan yang diakui sebagai sah dalam ketentuan tersebut. Dalam konteks menolakmutasi, jika seorang pekerja menolak mutasi yang dianggap merugikan atau tidaksesuai dengan kesepakatan awal, hal ini bisa menjadi alasan untuk mempertahankan posisinya. Namun, menolak mutasi bukanlah alasan yang secara eksplisit diatur dalam Undang-Undang sebagai alasan sah untuk PHK.Peraturan Pemerintah Nomor 35 Tahun 2021 juga menegaskan bahwa pemutusan hubungan kerja harus mengikutiprosedur yang jelas dan memperhatikan hak-hak pekerja. Jika mutasi tidak sesuaidengan kesepakatan kerja, pekerja berhak untuk menolak. Namun, perusahaan jugamemiliki hak untuk melakukan mutasi dengan syarat tertentu. Jika pekerja menolak dan perusahaan menganggapnya sebagai pelanggaran, PHK dapat dilakukan, tetapi harus mengikuti proses dan ketentuan hukum yang berlaku. Putusan Majelis Hakim pada perkara Nomor 68/Pdt.Sus-PHI/2023/Pn Pbr dalam pertimbangannya sudah benar menerapkan dan sesuai dengan Undang Undang Ketenagakerjaan. Perlindungan hukum terhadap pekerja haruslah mendapatkan haknya sebagai pekerja yang diputus hubungan kerjanya dengan mendapat haknya berupa uang pesangon yang tercantum dalam Pasal 155 dan Pasal 156 Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan
